1. Acceptance of Terms
By accessing startitservices.com, using any of Startit Services LLC's services, completing a contact form, making a payment, or signing a work order, you ("the Client") acknowledge having read, understood, and accepted these Terms and Conditions in their entirety, as well as our Privacy Policy.
If you disagree with any of these terms, we ask that you not use our services. Startit Services LLC reserves the right to modify these terms at any time, with at least 30 days prior notice for material changes.
Important note: Continued use of the site after posting changes constitutes acceptance of the new terms. The current version will always be available at startitservices.com/legal/terms.
2. Description of Services
Startit Services LLC offers the following services through startitservices.com:
Startit Sites — Premium web development
Premium-level websites built with GSAP, cinematic animations and brand identity, in three packages:
Single-page site with brand identity, up to 5 sections, contact form, mobile version, basic SEO, and 30 days post-launch support.
Everything in Presencia, plus: up to 7 pages, advanced GSAP animations, integrated blog, Lighthouse 90+ on all four metrics, and 60 days post-launch support.
Everything in Negocio, plus: custom functionalities, Stripe payment integration, client area, 90 days priority support, and 2 post-launch digital strategy sessions.
Startit Labs
Development of SaaS applications, APIs, and custom integrations. Specific terms for each Labs project are detailed in the work order signed by both parties.
Startit Reads
Sale of the book From Debt to Capital in digital format (PDF/ePub) and print through third-party distribution platforms. The terms of each sales platform apply additionally.
3. Contracting Process and Work Order
The contracting process follows the steps below. No work will begin until the formalization stage is properly completed:
- Step 1 — Initial request: The Client completes the contact form at startitservices.com/about#contacto describing their project.
- Step 2 — Validation and proposal: Startit reviews the request within 2 business days and sends a proposal with scope, deliverables, and price.
- Step 3 — Brief and acceptance: The Client approves the brief in writing (email or digital signature). Brief approval constitutes formal acceptance of the project scope and price.
- Step 4 — Payment and kickoff: Work begins upon receipt of full payment. The delivery timeline counts from the payment confirmation date.
- Step 5 — Delivery milestones: Startit delivers prototypes and progress according to the agreed schedule. The Client has 48 hours per round to review and send consolidated feedback.
- Step 6 — Final delivery and launch: The site launches once the Client gives final written approval. Final approval transfers content responsibility to the Client.
Revisions outside the original scope (structural design changes, additional pages, features not covered in the brief) are quoted and billed separately.
4. Payment Policy
One-time payment
All Startit Sites packages are charged as a one-time payment at the start of the project, before any work begins. There are no installment payments unless previously agreed in writing signed by both parties.
Payment processor
All payments are processed securely through Stripe, Inc. By making a payment, the Client also accepts Stripe's Terms of Service available at stripe.com/legal. Startit does not directly store credit card data.
No-refund policy
No refund after work begins: Once Startit has confirmed payment and begun work (Brief approved + payment received), the payment is non-refundable. This reflects that design, development, and infrastructure costs are incurred immediately.
Limited refund exceptions:
- If Startit cannot start the project within 5 business days following payment through no fault of the Client, the Client will receive a full refund.
- If the project is cancelled before Startit has dedicated more than 4 hours of work, Startit may, at its discretion, issue a partial credit.
- Payment disputes through Stripe must be initiated within 7 calendar days of the charge.
5. Intellectual Property
License to client over the delivered site
Upon full payment and final project acceptance, Startit Services LLC grants the Client a perpetual, non-exclusive, irrevocable, royalty-free license to use, maintain, modify, and operate the delivered website, including project-specific source code ("custom code").
Rights retained by Startit
Startit Services LLC retains all intellectual property rights over:
- The methodology, processes, and proprietary workflows developed by Startit.
- Reusable base code (generic UI components, animation utilities, internal libraries) that Startit uses across multiple projects.
- Startit's own design system, color tokens, typefaces, and style guides.
- Any code, design, or content not specifically created and paid for as part of the Client's project.
This distinction does not limit the Client's use of their delivered site; it simply means Startit may reuse its generic components in other projects.
Client intellectual property
The Client retains ownership of all content they provide: text, images, logos, photographs, videos, and brand materials. Startit makes no claim to the Client's content.
6. Client Representations and Warranties
By engaging Startit's services and providing materials for the project, the Client represents and warrants that:
- They have full legal authorization to use all materials they provide, including logos, images, photographs, texts, and any other content.
- The provided materials do not infringe any copyright, trademark, privacy rights, or any other third-party rights.
- They hold the necessary licenses to use fonts, stock images, icons, and any third-party assets they request to be incorporated into the site.
- They have legal authority to enter this agreement on behalf of the entity or person they represent.
- The resulting website will be used for lawful purposes and will not violate any applicable federal, state, or local law.
The Client will indemnify Startit for any third-party claims arising from breach of these representations.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY THE LAW OF THE STATE OF FLORIDA, STARTIT SERVICES LLC SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of data, or loss of business opportunities.
- Damages resulting from service interruption, third-party failures (hosting, DNS, CDN), cyberattacks, or events outside Startit's control.
- Damages resulting from the Client's or Client-authorized third parties' incorrect use of the delivered site.
- Losses related to changes in search engine algorithms after site delivery.
Maximum liability cap:
In no event shall Startit Services LLC's total cumulative liability arising from or related to these Terms or the services provided exceed the total amount actually paid by the Client to Startit for the specific project or service giving rise to the claim during the twelve (12) months preceding the liability-generating event.
Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so the above limitations may not fully apply. In such case, Startit's liability will be limited to the maximum permitted by applicable law.
8. Indemnification
The Client agrees to defend, indemnify, and hold harmless Startit Services LLC, its directors, employees, contractors, and agents from any claim, demand, damage, loss, liability, cost, or expense (including reasonable attorney's fees) arising from or related to:
- The Client's or its users' use of the delivered website.
- The Client's breach of these representations, warranties, or obligations.
- Content provided by the Client that infringes third-party rights or violates applicable laws.
- Any illegal or unauthorized activity conducted through the Client's website.
9. Post-Launch Support
Each package includes a post-launch support period for minor corrections, bugs, and content adjustments:

Support does not include: development of new features, redesign of existing sections, creation of new pages, integrations not covered in the original brief, or structural design changes. These are quoted separately.
Support requests must be sent to info@startitservices.com with the subject "Support — [project name]". Startit responds within 2 business days (Presencia/Negocio) or in under 4 business hours (Marca).
10. Acceptable Use Policy
By accessing startitservices.com, you agree not to engage in any of the following activities:
- Web scraping, systematic crawling, or mass content collection from the site without prior written authorization from Startit.
- Attempting to gain unauthorized access to Startit's systems, servers, or databases.
- Denial-of-service attacks (DoS/DDoS), fuzzing, or any penetration testing without explicit authorization.
- Sending spam, malicious content, phishing, or unsolicited mass communications through site forms.
- Using the site for illegal, fraudulent activities, or those that violate third-party rights.
- Reproduction, distribution, or commercial use of site content without an express license.
Startit reserves the right to block access, report illegal activities to competent authorities, and claim damages for violations of this policy.
11. Service Availability and Uptime Disclaimer
Startit Services LLC strives to keep startitservices.com continuously available, but does not guarantee a specific uptime level. The site may experience interruptions due to scheduled maintenance, infrastructure updates, hosting provider failures, or events outside Startit's control.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12. Governing Law and Jurisdiction
Governing law: State of Florida, USA
These Terms and Conditions, and any dispute arising from or related to them or Startit's services, shall be governed and interpreted exclusively under the laws of the State of Florida, United States of America, without giving effect to any conflict of law provision that might require the application of the laws of another jurisdiction.
Exclusive jurisdiction: Florida courts
Subject to the arbitration clause in Section 13, any litigation not resolved through arbitration shall be subject to the exclusive jurisdiction of the state or federal courts located in the State of Florida, and the parties waive any objection to forum inconvenience.
13. Dispute Resolution
Direct negotiation (30 days)
Before initiating any arbitration or legal proceeding, the parties agree to attempt to resolve any dispute in good faith through direct negotiation. The party with a claim will notify the other in writing, describing the dispute and the resolution sought. The parties will have 30 calendar days from receipt of such notice to attempt to resolve the dispute by mutual agreement.

Binding arbitration (JAMS)
If the dispute is not resolved within the 30-day negotiation period, either party may initiate binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services), in accordance with its Streamlined Arbitration Rules in effect at the time of the dispute.
- Arbitration will be conducted in the language agreed upon by the parties (English or Spanish).
- The arbitration seat will be the State of Florida, USA, with the option to be conducted virtually.
- The arbitration award will be final, binding, and enforceable before any competent court.
- Each party will cover their own attorney's fees, unless the arbitrator determines that a party acted in bad faith.
- Arbitration will be conducted on an individual basis; class arbitrations are not permitted.
Exception: Either party may seek emergency injunctive relief from a competent court to prevent irreparable harm, without this being considered a waiver of the right to arbitration.
Class action and jury trial waiver
All claims are resolved on an INDIVIDUAL basis.
To the fullest extent permitted by law, you and Startit Services LLC waive (i) any right to participate as a plaintiff or member in a class action, collective action, private attorney general action, or any representative or consolidated proceeding; and (ii) any right to a jury trial. The arbitrator may award relief only on an individual basis and may not consolidate the claims of multiple persons. If this class-action waiver is found unenforceable as to a particular claim, that claim — and only that claim — shall be severed and brought in a court of competent jurisdiction in the State of Florida.
Right to opt out of arbitration (30 days)
You may opt out of this arbitration clause and class-action waiver by sending written notice to legal@startitservices.com within 30 days of first accepting these Terms, stating your name and intent to opt out. If you opt out, disputes will be resolved in the courts of the State of Florida under Section 12. Opting out does not affect any other provision of these Terms.
Arbitration and these Terms are also governed by the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.).
14. General Provisions
Severability
If any provision of these Terms is found invalid, illegal, or unenforceable by a competent court, such provision will be modified to the minimum extent necessary or eliminated, and the remaining provisions will continue in full force.
Entire agreement
These Terms, together with the Privacy Policy, Cookie Policy, and any work order signed between the parties, constitute the entire agreement between the Client and Startit Services LLC with respect to the services, and supersede any prior agreements or understandings, written or oral.
No waiver
Startit's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision, nor shall it affect Startit's right to enforce it in the future.

Startit Services LLC does not warrant that the services will be uninterrupted, secure, timely, or error-free, or that any defect will be corrected.
Third-party links and services
The site may contain links to or integrations with third-party services (payment gateways such as Stripe, sales platforms such as Amazon, social networks, and other providers). Startit Services LLC does not control and is not responsible for the content, policies, or practices of such third parties, and your use of them is governed by each one's own terms and policies.
16. Eligibility and Capacity
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the services, make purchases, or engage Startit Services LLC. The services are not directed to minors under 18, and we do not knowingly collect data from minors. If you contract on behalf of a company or other entity, you represent that you are authorized to bind it to these Terms.
